Seoul, Korea - Last May, Microsoft (MS) had claimed whopping KRW 210 billion in damages for the illegal use of its software. As the Ministry of National Defense took a firm stand against the claim by finishing a legal review on the issue, MS demanded a lump-sum Government Agreement worth KRW 13 billion per annum, instead.
Ministry of National Defense announced on the 12th that Microsoft raised the issue of Client Access License payment last May at first, but recently changed its demand to a Government Agreement. Korean Ministry of National Defense, however, says it will not respond to Microsoft’s offer, because it had not infringed any copyright by using illegal software and will substitute the Microsoft’s software with software provided by Haansoft.
An officer of Ministry of National Defense related to this matter commented, “CAL payment is a contractual matter and has nothing to do with the infringement. If there were a problem, Microsoft should be speaking to the IT service companies it had contracts with.” Samsung SDS, LG CNS, SK C&C and others supplied Microsoft’s software to Ministry of National Defense.
Meanwhile, a Microsoft Korea person commented that he is not well aware of the Ministry’s response, because it has not yet been communicated to Microsoft and emphasized that ‘Ministry of National Defense must pay the damages to Microsoft first and go after the IT service companies for not providing full information on the related matter.”
MS, 130억 GA 요구…국방부 딱 잘라 `거부`
마이크로소프트(MS)가 최근 국방부에 연간 130억원에 해당하는 일괄 정부계약(GA)을 요구한 것으로 확인됐다. MS는 지난해 5월 불법 소프트웨어(SW) 사용 피해액으로 무려 2100억원에 달하는 손배소 금액을 국방부에 제시한 바 있다. 국방부가 불법 SW사용에 관한 법률 검토를 끝내는 등 대응 수위를 높이자 MS가 합의를 유도하는 순서로 방침을 선회한 것으로 보인다.
국방부는 MS가 지난해 5월 클라이언트 접속 라이선스 (CAL) 비용문제를 제기한 후 법적 대응 없이 최근 GA만을 요구했다고 12일 밝혔다.
GA는 MS오피스를 포함해 다양한 SW를 일괄 구매하는 정부계약을 뜻한다. MS가 요구한 GA 규모는 연간 130억원이다.
하지만 국방부는 GA에 응하지 않겠다는 방침이다. 한컴오피스를 도입해 MS오피스 등 일부 제품이 필요 없다는 이유다. 필요한 SW를 부분적으로 구매해 쓰기로 했다. 국방부는 작년 11월 한글과컴퓨터와 제휴해 한컴오피스 등 170억원 규모의 SW를 기증받았다.
국방부는 불법 SW를 사용해 저작권을 위반한 사실이 없다는 것도 GA를 거부한 배경으로 설명했다. 나형두 국방부 정보체계통합담당관은 “CAL 비용은 계약상의 문제지, 불법 SW 사용과 관계가 없다”며 “계약에 문제가 있다면 MS와 계약한 IT서비스 기업과 논의할 사항”이라고 말했다. 국방부에 MS SW 제품을 공급한 IT서비스 기업은 삼성SDS, LG CNS, SK C&C 등이다.
문화체육관광부도 작년 5월부터 10월까지 세 차례에 걸쳐 공공기관 대상 SW 사용실태를 점검한 결과 국방부가 불법 SW를 사용한 적이 없다고 밝혔다. 장영화 문화체육관광부 저작권보호과 서기관은 “법적 근거를 기반으로 중앙정부기관을 모두 조사한 결과 불법 SW를 사용하는 기관은 국방부를 포함해 거의 없었다”고 설명했다.
중앙행정기관은 대부분 전 직원이 해당 SW를 사용할 수 있는 `사이트 라이선스` 계약을 하고 있다. 중앙정부기관의 불법 SW 사용률은 0.16%다. 문화부는 다음 달 국방부와 MS 간에 이슈가 됐던 SW CAL 사용료에 대한 설명과 문제제기 시 대처방안 등을 수록한 안내책자를 발행해 공공기관에 배포한다.
한국MS 관계자는 “최근 국방부의 방침을 전달받은 바 없어 자세히 알지 못한다”며 “국방부는 직접 MS에 배상한 이후 IT서비스 업체에 제대로 정보를 받지 않은 것에 대한 구상권을 행사해야 한다”고 강조했다.
