Seoul, Korea - The U.S. International Trade Commission (ITC) is to make the final ruling on Apple’s infringement of Samsung Electronics’ patent on the 7th (the U.S. local time). If the commission rules any one of patents were infringed, Apple may not be able to bring some of its products into the U.S. market.
In its preliminary ruling last August, ITC decided that Apple did not infringe Samsung’s patent, but it is making the final ruling on Samsung’s appeal.
The direction of ITC’s final ruling depends on how far the commission will recognize the authority of Samsung’s standard patent for which Fair, Reasonable And Non-Discriminatory (FRAND) had been declared. To Samsung’s claim, Apple argued Samsung couldn't claim infringement because it declared FRAND on a standard patent.
The patent experts believe that there is only a small chance of ITC giving contradictory decision this time, but they do agree that it will take only one infringement to stop Apple from importing some of its own products into the U.S.
Meanwhile, the preliminary ruling on Apple’s infringement claim against Samsung is to be made on April 1st.
삼성전자, 美서 아이폰 수입금지 시킬까
삼성전자가 미국서 애플 아이폰을 수입금지 시킬 수 있을지 관심이 모아진다.
미국 국제무역위원회(ITC)가 7일(현지시각) 애플이 삼성전자 특허를 침해했는지에 대한 최종판정을 내린다. 단 1건이라도 침해로 판정되면 애플 일부 제품이 미국 시장 수입이 금지된다.
ITC는 7일 애플이 삼성전자 △3G 무선통신 관련 표준특허 2건과 △스마트폰에서 전화번호 자판을 누르는 방법 특허 △디지털 문서를 열람•수정하는 방법 특허 등 4건을 침해했는지 최종판정한다.
ITC는 지난해 8월 예비판정에서 애플이 삼성전자 특허를 침해하지 않았다고 결론 내렸는데 삼성전자가 재심사를 요청해 이번에 다시 판정을 내린다. ITC는 삼성전자와 애플 간 특허 침해 판정이 미치는 여파가 큰 만큼 이례적으로 재심사를 진행하고 있다.
ITC 최종 판정은 `프랜드(공정하고 합리적이며 비차별적인)를 선언한 표준특허 권한을 어디까지 볼 것인지에 달렸다. 애플은 삼성전자가 표준특허에 대해 프랜드를 선언해 침해를 주장할 수 없다는 입장이다.
특허 전문가들은 ITC가 기존 예비판정을 뒤집을 가능성은 매우 낮다고 입을 모으고 있다. 하지만 1건이라도 침해판정이 나오면 미국 내 애플 일부 제품 수입이 금지된다. 아이폰5와 아이패드 미니, 아이패드4 등 최신 제품은 제소 대상이 아니여서 수입이 금지 판정이 나더라도 시장에 미치는 영향은 제한적이다.
한편, 애플이 삼성전자가 자사의 특허를 침해했다며 제소한 사건에 대해서는 다음달 1일 예비판정이 나오며 최종판정은 8월 1일이다.
