Samsung’s Patent Battle, Against LG This Time?

Seoul, Korea - The pupil recognition featured in Galaxy S4 may start another patent battle for Samsung Electronics, against LG Electronics this time. LG had already applied for a patent of practically the same technology 8 years ago. 

On Tuesday, LG announced that it had applied for a patent on ‘mobile telecommunication terminal with eye-sensing functionality’ in December 2005. According to the application, LG’s technology will scroll the screen to the direction of a pupil, using the front camera as a sensor. The application has recently been registered as a patent by Korean Intellectual Property Office. 

LG also had applied for a patent on ‘a portable terminal and its controlling method’ in August 2009. This technology pauses the video when the sight of viewer is not directed toward the screen. 

Samsung’s Galaxy S3 which was launched last year came with the Smart Stay, which recognizes the pupil and keeps the screen on as long as the eyes are on the screen. Galaxy S4 premiered on the 14th features the Smart Pause that pauses the video replay when the user turns away from the screen and resumes when turns back to the screen. 

However, the experts say that it may be difficult for LG to proceed to the lawsuit even if it submitted the patent application before Samsung, because the exact technology Samsung adopted may be different from that of LG.

삼성, 특허 싸움…이번엔 LG와 한판 

갤럭시S4에 적용된 스마트폰 카메라 눈동자 인식 기술을 두고 삼성전자와 LG전자의 특허 시비로 비화될 조짐이다. 

LG전자가 이미 8년 전 이 기술을 특허 출원한 것으로 나타났기 때문이다. 디스플레이 특허분쟁이 화해 무드로 전환된 가운데 두 회사가 다시 스마트폰으로 일전을 불사할 지 관심이 모아진다. 

19일 LG전자는 지난 2005년 12월 `안구 감지 기능이 구비된 이동통신 단말기`에 관한 특허를 출원했다고 밝혔다. 이 기능은 전면 카메라가 눈동자 움직임을 인식하면 그 방향으로 화면을 스크롤하는 기술이다. 이 특허는 최근 한국 특허청에서 등록이 결정됐다. 

LG전자는 2009년 8월 `휴대 단말기 및 그 제어방법`에 관한 특허도 출원했다. 이 특허는 스마트폰 사용자 시선이 화면을 향하지 않을 경우, 동영상 재생을 일시 정지하는 기술이다. LG전자는 이 특허를 기반으로 `스마트 비디오` 기술을 내달 `옵티머스 G 프로`에 탑재할 계획이다. 

화면을 보고 있을 때 화면이 꺼지지 않는 `스마트 스크린`도 LG전자가 2010년에 9월 미국과 한국에서 특허를 출원했다. 지난해 말 미국 특허청에 등록을 마쳤다. 
지난해 출시된 삼성전자 갤럭시S3는 눈동자를 인식해 화면을 보고 있으면 화면이 꺼지지 않는 `스마트 스테이` 기능이 있다. 지난 14일 공개된 갤럭시S4도 동영상을 보다가 사용자가 고개를 돌리면 재생이 멈추고 다시 보면 재생되는 `스마트 포즈`가 탑재됐다. 

LG전자가 특허 출원한 내용과 사실상 같은 역할을 하는 기능이다. 특허 전문가들은 LG전자가 관련 기술 특허를 먼저 출원했더라도 소송을 진행하는 것은 쉽지 않다고 분석했다. 

삼성전자가 채택한 기술이 LG전자 기술과 다를 수 있기 때문이다. 실제로 안구를 인식하지 않고 얼굴 전체나 코 등 다른 신체 부위를 인식해도 같은 기능을 구현할 수 있다. 

LG전자 관계자는 “눈동자 관련 특허는 경쟁사보다 먼저 출원한 만큼 특허침해 여부를 확인해 볼 것”이라고 말했다. 

삼성전자 측은 “스마트 포즈, 스마트 스크롤 등 인식 기능은 당사가 자체 개발한 고유 기능이며 기술 구현 방식이 다르다”고 대응했다.
