Seoul, Korea - The Korea Communications Commission (KCC) is known to have made a decision to impose suspension of business on only one out of three major telecommunications service providers,
according to the relevant sanctions to be released on July 18. SK Telecom, KT and LG U+ are waiting for the result to be made with bated breath.
KCC is expected to put down an agenda of ordering only the one that ignites the subsidy competition among the three telecommunication companies to suspend its business during its plenary session on July 18.
“KCC believes the imposition of business suspension on the main offender is the most effective way in terms of aggravated punishment for wrongfully providing subsidies,” says a source from KCC.
As the sequential business suspension imposed on the three companies early this year was no use, KCC has decided to bring in such a strong countermeasure against them. On the contrary to its purpose, the former countermeasure has rather boosted the subsidy competition among the three telecommunications companies.
The crackdown will be conducted for two separate periods. When found to be the main offender during each period, the concerned company is going to be ordered to suspend its business and to be fined as well.
방통위, 불법 보조금 주도 사업자에 `단독 영업정지` 처분한다
방송통신위원회가 오는 18일 발표할 이용자 차별적 휴대폰 보조금 관련 제재 방안에 통신사업자 세 곳 가운데 1개사만 영업정지를 부과하는 방안을 결정한 것으로 알려졌다. SK텔레콤·KT·LG유플러스 등 통신 3사는 주도 사업자로 낙인찍힐까 숨죽이며 결과를 기다리는 중이다.
방통위는 통신 3사 중 먼저 경쟁의 불을 지핀 주도 사업자 한 곳을 선정해 단독으로 영업정지 제재를 부과하는 방안을 18일 전체회의에 보고 안건으로 상정할 예정이다.
방통위 관계자는 “전체회의에서 공약한대로 주도 사업자에 대한 가중 처벌 방안 중 단독 영업정지 방안이 가장 효과적이라는 결론을 냈다”고 말했다. 방통위는 주도 사업자로 분류된 통신사 한 곳만 영업정지와 과징금 처분을 동시에 받고, 나머지 두 개 회사는 과징금만 받는 식으로 제재할 방침이다.
단독 영업정지라는 극약처방을 꺼내든 것은 올해 초 실시한 순차 영업정지가 사실상 효과가 없었다는 비판이 많았기 때문이다. 순차 영업정지 한 통신사 영업정지 기간 동안 다른 두 회사가 해당 통신사 가입자를 빼앗아오는 행태가 반복되면서 오히려 보조금 경쟁을 더 부추기는 꼴이 됐다.
방통위 관계자는 “경쟁사 영업정지라는 만회의 기회를 제공하지 않고 단독 영업정지를 부과받게 되면 일정 수준 이상의 가입자 순감이 있을 수밖에 없다”고 설명했다. 이 관계자는 “주도 사업자가 아니더라도 이용자 차별적 보조금 지급이라는 `죄질`은 통신 3사 모두 비슷하지만 제재 효과를 내기 위해선 어쩔 수 없다”고 덧붙였다.
다만 조사 대상 기간이 1월 8일~3월 13일과 4월 22일~5월 7일로 나뉘어있기 때문에, 각 기간당 1개사 씩 총 2개사가 영업정지를 부과받을 가능성이 높다. 즉, 통신 3사 중 첫 번째 혹은 두 번째 조사기간에 주도 사업자로 적발되면 해당 기간에 대한 영업정지와 과징금 처분을 함께 받고, 다른 기간에 대한 처벌로는 과징금만 부과받는다.
통신업계 한 관계자는 “LTE 2위 탈환을 위해 강력하게 드라이브를 건 KT와 자금력이 강한 SK텔레콤이 차례로 영업정지를 부과받을 가능성이 높다”면서도 “아직까지 방통위에서 별다른 방침을 알려주지 않아 결과만 기다리고 있다”고 말했다.
