Seoul, Korea - LG Display has submitted on the 20th an cancellation application for its injunction request against the sales of Galaxy Note 10.1 filed against Samsung Electronics and Samsung Display in December last year.
LG’s move was made after Samsung had dropped its injunction request against LG’s infringement of Samsung’s OLED technology. The lawsuit LG Display dropped on the day was the application for an injunction against infringement of 3 In-Plane Switching patents related to the vertical alignment LCD technology.
The two companies had agreed earlier to the principle of ending the consumptive emotional fight and reconcile. Now that both Samsung and LG dropped their injunction applications, the amicable settlement is likely to follow.
The two companies plan to resolve the patent lawsuits by separate working-level negotiations. LG has lodged a lawsuit against Samsung for 7 infringements on its OLED patents, and Samsung sued LG for alleged infringement of 7 Plane to Line Switching patents vice versa. The working level persons from each side are soon to start the negotiation.

LG디스플레이(대표 한상범)는 지난 해 12월 삼성전자·삼성디스플레이를 상대로 제기한 `갤럭시노트 10.1 판매금지 가처분 신청`에 대한 취하 신청서를 서울중앙지방법원에 20일 제출했다고 밝혔다.
삼성이 지난 12일 `유기발광다이오드(OLED)기술 등에 대한 침해금지 가처분 신청`을 취하함에 따른 조치다. 이날 LG디스플레이가 취하한 소송은 광시야각 액정 기술인 IPS(In-Plane Switching) 특허 3건에 대한 침해금지 가처분 신청이다.
앞서 양사는 소모적인 감정 싸움을 끝내고 화해한다는 원칙에 합의했다. 삼성과 LG 모두 가처분 신청을 우선 취하하면서 원만한 해결의 길이 열렸다.
두 회사는 특허 소송에 대해서는 별도의 실무 협상을 통해 해결하겠다는 입장이다. LG는 삼성에 대해 OLED 특허 7건을 침해했다고 소송을 제기했으며, 삼성은 LG를 상대로 PLS(Plane to Line Switching) 특허 7건을 침해했다는 소송을 건 상태다. 양사 실무진들은 조만간 만나 두 소송에 대해 협상할 계획이다.
LG디스플레이 관계자는 “앞으로도 소모적인 감정 싸움 대신 공정한 경쟁을 추구할 것”이라며 “특허 가치를 정확히 평가해 상호 권리의무 관계를 명확히 하면서 해결방안을 모색해 가겠다”고 말했다.
삼성디스플레이 관계자는 “LG디스플레이의 가처분 신청 취하를 환영한다”며 “디스플레이 산업의 경쟁력 강화를 위해 건설적인 방향으로 협상하겠다”고 말했다.
