Microsoft Set Out to Widen Its Aim to All Directions

Seoul, Korea - Microsoft went to Ministry of Culture, Sports and Tourism (MCST) after Ministry of National Defense (MND) rejected its Client Access License (CAL) infringement claim, to appeal to the authority on administration of copyrights. 

The industry interpreted the visit to signal Microsoft's intention to broaden its copyright front to all directions. 

According to government officials on Wednesday, Microsoft asked for a meeting with the Ministry and visited the office accompanied by the attorneys from Lee & Ko. At the meeting, Microsoft claimed that MND was in violation of the copyright, technically, further explaining that the technical infringement occurred when more users than granted by the CAL accessed the server to use Microsoft's software. 

MCST responded to Microsoft by making clear that the situation at hand was not about the infringement of copyright, and the two parties must resolve the dispute by themselves. Regarding an opinion in the trade that there will be an international trade dispute arising from Microsoft’s claim, MCST also commented that “there is Copyright Act and the problem shall be resolved by the Act, not by any result of international trade dispute.” 

Meanwhile, Microsoft Korea tried to contain the over-reaction of industry by explaining that the visit was purely to explain its CAL license policy to the copyright policy administrator.

국방부로부터 정부계약(GA)을 거절당한 한국마이크로소프트(MS)가 저작권을 총괄하는 문화체육관광부를 방문, 국방부가 클라이언트접속라이선스(CAL)를 침해했다고 주장했다. 업계는 MS가 저작권 문제를 전 방위로 확대하겠다는 의지로 이해했다. 문화부는 저작권 침해 여부를 판단할 사안이 아니며 당사자끼리 해결할 문제라는 뜻을 한국MS에 밝혔다. 

13일 정부에 따르면 한국MS 관계자는 지난 8일 법무법인광장 소속 변호사와 함께 문화체육관광부를 방문한 자리에서 CAL 정책과 관련, 국방부가 기술적으로 저작권을 침해했다고 설명했다. 문화부 방문은 한국MS 요청에 따른 것이다. 

한국MS 관계자는 이 자리에서 국방부가 계약한 CAL 라이선스보다 많은 사용자 수가 서버에 접속해 운영 소프트웨어(SW)를 사용하는 과정에서 기술적인 저작권 침해가 발생했다고 강조했다. 

문화부는 이에 저작권 침해 여부를 판단할 수 없다는 뜻을 전달했다. CAL 라이선스 이슈는 계약상의 문제여서 당사자 간에 해결해야 한다는 시각이다. 문화부 관계자는 “저작권 침해 여부는 소송을 통한 저작권법에 따라 판결해야 한다”고 말했다. 

문화부는 MS와 국방부 CAL 라이선스 이슈로 업계에서 제기된 무역 분쟁에 대한 입장도 밝혔다. 문화부 관계자는 “저작권법이 있어 문제가 있으면 법으로 판결을 내리면 된다”며 “무역 분쟁이 일어날 이유가 없다”고 전했다. 

한국MS 관계자는 “CAL 라이선스 정책에 대해 설명을 해줘야 해 저작권 소관부처인 문화부를 방문한 것”이라며 확대 해석을 경계했다.
