SEOUL, KOREA – Five nations- the US, Japan, the EU, South Korea and China- will build a big data system in order to allow companies and people around the world to have better access to information on patents.
The Five IP Offices (IP5), the name given to a forum of the five largest intellectual property offices in the world, held a summit meeting in Silicon Valley in the US on June 4 through 5 and discussed ways to reinforce international collaboration on evaluations of patent applications and enhance consistency in nations’ patent examination procedures.
The heads of the five largest intellectual property offices decided to have each nation’s collection of patent information shared by IP5 members and offer the shared information to companies and general people for free or at the marginal cost. The IP5’s such move is designed to improve access to global patent information that has been growing exponentially.
Also, the IP5 has decided to set up a global patent information system by 2017 so as to allow patent application filers to have one-stop access to each nation’s patent information and information on the process and outcome of their patent applications. This system will be connected to WIPO (World Intellectual Property Organization)’s CASE (a patent examination information network).

세계 지식재산 선진 5개국, 특허정보 `빅데이터`체제 구축
세계 지식재산 선진 5개국(미국•일본•유럽연합•한국•중국)이 기업과 일반인이 세계 특허정보에 손쉽게 접근할 수 있도록 특허정보 빅데이터 체제를 구축한다.
세계 지식재산 선진 5개국 특허청 협의체(IP5)는 4일과 5일 미국 실리콘밸리에서 정상회의를 갖고, 심사업무의 국제적 공조를 강화하고 국가간 특허심사의 일관성을 높이는 내용의 특허제도 개선 방안을 논의했다.
IP5 특허청장들은 우선 특허정보 빅데이터 체제 구축을 위해 세계 각국에서 수집한 특허정보를 IP5 특허청간에 공유하고, 자국 기업과 국민에게 무상 또는 최소한의 한계비용으로 보급하는 정책을 전격 채택했다. 이는 기하급수적으로 늘고 있는 전 세계 특허 문헌 정보에 대한 접근성을 개선하기 위한 것이다.
IP5는 또 각국 특허청이 각기 다른 방식으로 분류하는 특허 문헌을 단계적으로 통일된 분류 체계로 만들어 나가기로 합의했다. 현재 한국 등 대부분 국가는 세계 표준격인 IPC(International Patent Classification)를 적용중이며, 출원량이 많은 일부 국가는 IPC보다 더 세분화된 독자적인 특허분류체계를 사용하고 있다.
IP5는 합의된 협력 체계에 따라 서로 다른 분류 체계를 점진적으로 조화시켜 나가면서 IPC에 결과를 반영하기로 했다.
글로벌 특허정보시스템도 만들어진다.
IP5는 각국 특허문헌, 심사진행 정보 및 결과를 출원인이 직접 원스톱으로 일괄 조회할 수 있는 `글로벌 특허정보시스템`을 오는 2017년까지 구축하기로 했다. 시스템 구축 후에는 세계지식재산권기구(WIPO)의 특허심사정보망(CASE)과 연결해 국제출원 및 심사 정보를 조회할 수 있도록 할 계획이다.
IP5는 심사 업무의 중복을 피하고 심사의 일관성을 높이기 위해 심사 업무에 대한 공조도 강화하기로 했다. 현재 양자 프로그램으로 시행중인 특허심사하이웨이(PPH)를 통합해 시행하고, 이를 국제특허출원과 연계하는 방안을 추진하기로 합의했다.
이를 위해 특허심사관 교육 프로그램을 활성화하기로 하고, 한국 특허청 주도로 원포털 사이트 `IP5 심사관 훈련 플랫폼`을 구축하기로 했다.
회의에서는 차기 IP5 정상회의 의장국에 한국을 선정하고, 내년 6월 부산에서 회의를 개최하기로 했다.
김영민 특허청장은 “이번 합의를 바탕으로 특허정보에 대한 개방성과 접근성이 크게 높아질 것으로 예상된다”며 “우리 기업은 이를 잘 활용해 지재권 전략을 수립할 필요가 있다”고 말했다.
