Law and Policy for Cyber Security and Privacy in Asia

SEOUL, KOREA - Importance of Security and Safety of Cyberspace 

Although it is regarded as a new and virtual domain, cyberspace is already part of our real life in the physical world. While we benefit from the use of cyberspace in communicating and in other areas, we are also suffering from various types of cyber attacks from outside states as well as terrorists and criminals groups.

Prof. Park stated, “Cyberspace should be protected for the safety and security of our lives and systems. One of the critical missions for this goal is international cooperation, including the development and application of international rules for cyber security which are still absent. As a matter of fact, various groups which are stakeholders in cyberspace, including the governments of major States such as the U.S., EU and Russia, have been making efforts in making rules for cyberspace.”

A recent notable result is the publication of the Tallinn Manual on the international law applicable to cyber warfare. However, countries in Asia, including China, Japan and Korea, are comparatively quiet and inactive in this international effort to define the rules for cyberspace. The Cyber Law Centre at Korea University and its program for the Asia Forum on Cyber Security and Privacy are expected to contribute to the development of rules for cyberspace and the promotion of cooperation among Asian countries.

Cyber Law Centre at Korea University

The Cyber Law Centre at Korea University was established in 2012 to engage in research on cyber laws covering human rights such as free expression, economic matters such as trade and intellectual property, crime, terror, and war. The Centre mainly consists of professors at Korea University and experts outside the University. Dr. Park personally deals with the issues over data protection (privacy), cyber security including terror and war, and digital trade. The Centre is managed principally by Dr. Chung Myung-hyun and with the cooperation of Dr. Bae Yeon-jae. Both are research professors at Korea University.

The Centre has started a partnership with the Graduate School of Information Security and in particular Dean Prof. Lim Jong-in who is the leading expert in the matters covered by the Centre. Legal expertise at the Centre and technical expertise at the Graduate School of Information Security will lead the academic and practical expertise in Korea and in Asia.

Furthermore, the Centre is particularly working towards making international cooperation with experts abroad in the U.S. and EU as well as in Japan and China. One of the programs of the Centre is the organization of the Asia Forum on Cyber Security and Privacy, as well as forming a partnership with Keio University in Japan.

The Centre will produce academic and practical works in the area of cyberspace for readership abroad as well as in Korea. The Centre will also rear experts of law and policy in the area of cyberspace.

 

Asia Forum on Cyber Security and Privacy

The Asia Forum on Cyber Security and Privacy was launched last year to promote the discussion in matters relating to cyber security and privacy in Asia. The Forum is mainly being sponsored by Microsoft, and coordinated with Keio University in Japan. Two conferences have already been held at Korea University and Keio University in November 2012 and May 2013, respectively.

The Forum is organized around to areas: bilateral and regional. At the bilateral level, the Forum focuses on legal, technical, and policy cooperation between Japan and Korea with the involvement of academicians, businesses, and officials in the government. At the regional level, the Forum invites experts beyond the two countries in Asia to enable far-reaching discussions on the matters concerned. The main purpose is to find a solution which can also suit businesses and governments.

My name is Nohyoung Park. I have been teaching international law at Korea University since September 1990. My major was originally international economic law, but has expanded to negotiations and, recently, cyber security and data protection. I am the founding president of the Korean Society of International Economic Law. The Cyber Law Centre was established at Korea University last year on my initiative. I belong to the advisory group for the third Cyber Space Conference, to be held in October, in the area of international security. I am currently involved in research on cyber matters, such as cyber warfare and terror, digital trade and the ABS in the Nagoya Protocol. I am determined to fully engage in the study of legal rules on the cyberspace including security, war and terror, and data protection.
