Seoul, Korea - According to a report, top 500 Korean firms were involved in 26,000 lawsuits of which cost amounted to KRW 20 trillion - translated, it was 146 lawsuit cases per company with KRW 107 billion in cost. Among them, 78 % were closely related to consumer’s livelihood, such as banking, construction and insurance.
In an analysis by the CEO SCORE, there were 26,640 instituted and charged cases pending at 182 companies listed on the securities exchange that must disclose the involvement in lawsuits, and the total amount claimed was KRW 2.5930 trillion. Woori Bank had lawsuit involving the highest cost of KRW 2.18 trillion, followed by POSCO (62 cases) with KRW 1.558 trillion. Even though POSCO was not involved in many lawsuits, the claimed amount for the cases with JFE Steel Corporation and Sumitomo Chemical for trade secret infringement and damage compensation stood at KRW 1.1600 trillion, which was the largest single case among the disclosed lawsuits.
Samsung Electronics had a billion dollar lawsuit with Apple, and Hyundai Motor Company was excluded from the analysis as it did not disclose lawsuits citing their insignificance in management. Meanwhile, the insurance companies were involved in the largest number of cases. LIG was involved in 5,090 lawsuits including charged cases, Samsung Life Insurance was in 3040, Samsung Card and Samsung Fire and Marine Insurance were in 2,000, respectively.
500대기업 소송에 몸살, 소송건수 26000건·금액 20조원
우리나라 500대 기업들이 총 20조원에 달하는 2만6000건의 소송에 휘말려 있는 것으로 나타났다. 1개 기업 당 건수는 평균 146건, 금액기준으론 1070억원 가량이 소송에 휘말려 있는 셈이다. 특히 전체 소송건수의 78%가 은행, 건설, 보험 등 소비자들의 생활과 밀접한 업종에 몰려 있었다.
19일 CEO스코어가 국내 500대기업 중 소송내용 공시가 의무화된 유가증권 시장 상장 182개사의 지난해말 기준 계류 중인 소송현황을 조사한 결과, 제소와 피소는 총 2만6640건이었고, 이에 따른 소송금액은 20조5930억원에 달했다.
금액기준으로 소송 규모가 가장 큰 곳은 우리은행으로 1305건에 소송가액은 2조180억원 규모다. 두번째는 포스코(62건)로 1조5580억원 규모에 달했다. 포스코는 일본 신일본제철 및 스미토모 금속과 영업비밀 침해 및 손해배상 등으로 1조1600억원이 넘은 소송을 벌이고 있는 점 때문에 적은 건수에도 소송가액은 높아졌다. 포스코와 신일본제철의 소송은 공시된 단일 건수 소송가액으로도 최다다.
국민은행은 1조1670억원(359건) 규모의 소송을 진행중이고 외환은행(1071건), 신한은행(369건)도 각각 8300억원대의 소송전에 휘말려 있었다. 이어 한신공영(6640억원), 한국전력공사(5380억원), SK건설(5200억원), 대우건설(5060억원), 현대건설(5030억원) 순이었다.
애플과 10억 달러 이상의 특허소송을 벌이고 있는 삼성전자와 현대차 등은 소송이 경영 상황에 큰 영향을 미칠 사안이 아니라며 소송내용을 공시하지 않아 이번 조사 대상에서 제외됐다.
한편 소송건수가 가장 많은 기업들은 보험사에 포진했다. LIG손해보험은 4515건의 제소를 포함해 총 5090건의 소송을 벌이고 있고, 삼성생명보험이 3040건의 소송에 휘말려 있다. 삼성카드와 삼성화재도 각각 2000여건의 소송 건수를 기록했다.
