Seoul, Korea - Korea Fair Trade Commission (KFTC) is known to have decided the claim lodged by NHN and Daum Communication alleging Google's unfair practices related to the smartphone operating system was unfounded.
NHN and Daum had submitted a claim to KFTC in April 2011, asserting that Google pressured the smartphone makers to exclude the competing search engines as Google supplied them the Android OS. At the time, Google had only 3% web search market share in the wired internet environment, but the same market share in mobile environment reached 15%, making its critics to claim that its dominance in the OS had rippled to the area of search engine market.
KFTC decided that the smartphone users were able to easily choose services offered by others than Google, including Naver and Daum, and Google had not deterred competition. The Commission also stated it considered the fact that the technological superiority in a specific area, especially in the areas of mobile or internet, is usually not maintained for a long time because of fast-developing technologies.
KFTC also stated that it was not able to find any evidence that Google unfairly pressured the smartphone makers.
The trade believed that KFTC also considered that the presence of Korean services in the mobile market had been growing since 2011.
The decision by KFTC is expected to make an impact to the European regulators who are reviewing the same subject, since the Commission's decision was the first one in the world made in relation to Google.
EU countries had been conducting investigations on the monopoly of search engine market by Google. On the 17th (local time), EU has officially denied Google's compromise that it will display its links and services, such as YouTube and Google Maps, grouped separately from other apps.

2년 넘게 끌어온 구글과 네이버·다음 연합군간 모바일 시장 불공정행위 논란에서 공정위가 구글 손을 들어줬다. 국내 인터넷 진영은 아쉬움을 표했다.
공정거래위원회는 스마트폰 운용체계(OS) 관련 불공정 행위를 했다며 NHN과 다음커뮤니케이션이 구글을 제소한 사안과 관련, 구글에 무혐의 결론을 내린 것으로 18일 확인됐다.
NHN과 다음은 지난 2011년 4월 구글이 스마트폰 제조사에 안드로이드 OS를 공급하면서 경쟁 회사 검색 엔진을 배제하도록 부당하게 압력을 행사했다며 공정위에 구글을 제소한 바 있다. 당시 구글은 유선 웹 검색 점유율은 3%에 못 미쳤지만 모바일에선 15% 안팎의 점유율을 보여, OS 지배력이 검색으로 전이됐다는 주장이 나왔다.
공정위는 스마트폰 사용자가 쉽게 네이버나 다음 등 다른 서비스를 이용할 수 있어 구글로 인한 경쟁제한 효과가 없다고 판단했다. 인터넷이나 모바일처럼 기술 발전이 빠른 분야에선 특정 분야 우위를 대체할 기술도 계속 등장한다는 점도 고려했다.
2011년 이후 네이버, 다음, 카카오톡 등 국내 서비스의 모바일 시장 영향력이 지속적으로 성장한 것도 판단에 영향을 미쳤다. 구글이 스마트폰 제조사에 부당한 압력을 행사한 증거도 찾을 수 없었다는 입장이다.
권철현 공정위 서비스업감시과장은 “소비자가 손쉽게 다른 서비스를 이용할 수 있는 대체성이 존재하고 구글의 검색 점유율이 낮기 때문에 경쟁 제한이 있다고 보기 어렵다”고 말했다.
국내 포털은 아쉬움을 나타냈다. 업계 관계자는 “모바일에서 가장 중요한 것이 사용자 시간 점유”라며 “안드로이드 OS와 밀접하게 연계된 메일·캘린더·플레이스토어 등 구글 앱이 차지하는 비중이 늘고 있다”고 말했다.
공정위의 이번 결론은 구글의 시장지배력 남용 여부를 조사 중인 유럽에도 영향을 미칠 전망이다. 이는 구글 관련, 세계 주요국 경쟁당국이 결론을 내린 최초 사례다.
유럽연합(EU)은 2011년부터 구글 검색 독점에 대한 조사를 진행해 왔다. 17일(현지시각) EU는 구글 검색광고 링크와 유튜브·구글지도 등 자사 서비스를 테두리쳐 화면에 표시, 다른 검색결과와 분리해 노출하겠다는 구글의 타협안을 거부했다.
